Definition of a Cosmetic Producty

Definition of a Cosmetic Product in India

A cosmetic product, as per Indian regulations, is any chemical composition, preparation or substance that is intended for cosmetic use i.e. application on the external human parts such as skin (epidermis), nails, hair, teeth, external genital organs, lips and the mucous membrane of the oral cavity for the purpose of changing the appearance, cleaning, perfuming, protecting or making them cosmetically more appealing.

This definition of a cosmetic product must take into consideration any or all of the following three conditions:-

  • The cosmetic product is either a preparation or a single substance
  • The cosmetic product should be used or applied only on the external body parts of a human
  • The cosmetic product should be used exclusively for:
    • Protecting [Toothpastes, Skin creams such as sun-blocks]
    • Cleaning [Shampoos, soaps and exfoliating creams]
    • Perfuming [Scents, Perfumes and the Deodorants]
    • Changing appearance cosmetically [Nail polish, hair color and makeup]
    • Maintenance [Tonics, hair conditioners and the skin lotions]

It must however be noted that the products with a primary function that doesn’t correspond to any of the 5 mentioned usages (as mentioned above) would fall under the purview of other streams of Indian legislation. For example, a disinfectant or an insect repellant might be a look alike to a cosmetic product but they would be subjected to biocides or medicinal legislation. Notably, some of these products may fall under the borderline category and for such an incidence the product would be evaluated as a special case interpretation under the regulatory requirements.
